These terms and conditions apply to Services provided by Leaves Ltd trading as Leaves Institute.

Terms & Conditions key definitions:

  • “we”, "our"or "us" refer to the business, Leaves Ltd or Leaves Institute.

  • “I”, "you", “your”, “applicant”, “me” and/or “student” refer to the person(s) applying and/or studying at Leaves Institute.

  • GDPR means General Data Protection Act.

  • CPD means Continuous Professional Development

  • Cookies mean small files stored on a user's computer or device.

  • CRB means Criminal Record Bureau

  • DBS means Disclosure and Barring Service

  • VLE means Virtual Learning Environment / Online Course Learning Platform

Section A: Important Disclaimer: 

  1. Once you have accepted an offer of a place on a course at Leaves Institute via email confirmation or booking via our homepage a legal contract is formed between you and Leaves Institute. 

  2. Please ensure that you read this document carefully before you choose to accept an offer of a space on one of Leaves Institute’s courses, if you have queries or questions regarding any aspect of this information please contact hello@leavesinstitute.com.

  3. I understand that my offer of a place, along with an invitation to enrol, is made on the basis that the information supplied in my application is true and complete, and that I hold the qualifications that I claim to hold. I understand that I may be asked at the enrollment stage to produce satisfactory evidence of my previous qualifications, and that Leaves Institute reserves the right to accept original documents only when requested. I understand that if I am found, at any stage, to have misrepresented my circumstances the offer and subsequent enrolment will be deemed null and void.

  4. I understand that my place on a course will be subject to me meeting any conditions identified, should any conditions be required they will be sent via email prior to enrollment. I understand that these conditions may require particular qualifications and/or legal requirements such as, CRB checks or DBS checks.

  5. I understand that as an applicant to a Leaves Institute course, I may be required to complete an additional entry assessment to demonstrate their competency levels in written English language. Leaves Institute reserves the right to retract an offer of a space on one of our courses, should the students not be confident enough to complete a course in English.

  6. These terms and conditions are in addition to the Leaves Institute Website Privacy Policy and Code of Conduct and apply to the sale of any Online Course and/or involvement in any research projects or events.  Please read these Terms and Conditions, Privacy Policy and our Code of Conduct carefully before purchasing an Online Course and/or agreeing to any involvement in any research projects or events.

  7. If there is any conflict between our Website Terms and Conditions, Privacy Policy and our Code of Conduct, then these Terms and Conditions and any Course Specific Terms and Conditions, then the conflict shall be resolved by applying the following order of priority: 

7.1 These Terms and Conditions stated within this document are our Standard Terms of Agreement and are for the purchase of all courses and/or the involvement in research projects and events, whether they are purchased or free of charge from Leaves Institute. 

7.2 For purchases of courses and/or agreement to involvement in research projects and events booked via our website, via email or via our homepage, it is deemed a confirmation of acceptance, which in turn means you agree to the terms of this agreement which are binding. 

  1. Upon occasion as an applicant to a Leaves Institute course, I understand that I may be asked for proof of prior industry qualifications, professional accreditation or proof of CPD, DBS checks or CRB Checks. 

  2. A description of all the Leaves Institute courses together with the dates on which the courses will begin are available on our Website: www.leavesinstitute.com. Leaves Institute will provide the services with due care and skill in accordance with the description set out on the website.

  3. Leaves Institute reserves the right to vary or withdraw any of the course content or delivery as described on the website without notice. 

  4. Whilst your success, satisfaction, wellbeing, aspirations and employability are extremely important to Leaves Institute, we do not make any guarantee to you that you will obtain a particular result, professional qualification or employment opportunity from your course booking or completion of any of the services whether that be an on-line course, a short residential course or a retreat. 

  5. Course Start Dates and Times

Course start dates and timetables will vary depending on each individual students’ actual global location. Applicants will be asked to select their preferred choice of online campus at the time of application. Students should choose the campus that fits the language and time zone they will be located in whilst completing the course. Please note that selecting the incorrect online campus location could result in the student not receiving the correct timetable. Online Education Delivery

Section B: Live Online Delivery: 

  1.  Live lectures form an important part of our online educational programme at Leaves Institute

  2. Global Delivery. Academic delivery can be delivered by academic staff from different countries. For this reason, we allocate timetables to students based on the time zone selected by the applicant at the point of taking up a Leaves Institute course. 

  3. Timetable Allocation. Correct choice of online campus is the responsibility of the student and although we will do everything possible to assign you to the correct campus, Leaves Institute will not be held responsible for incorrect allocation after confirmation of space offered on one of our online courses, research projects and/or events. Leaves Institute is unable to refund should incorrect delivery of timetable be delivered to the student, but we will deem to rectify the situation to make sure the correct timetable and time zone allocation is allocated as soon as possible.  

  4. Technical Specifications Required. To ensure you have the optimal online educational experience, we recommend our students read and comply with the recommended Leaves Institute Technical Specifications, which you can request prior to starting your course at hello@leavesinstitute.com and or you will be taken through during your enrolment period.

  5.  Reading. I understand that most courses will expect me to read around and research my subject. I understand that I will probably have some recommended key texts for each Assignment within my course, as a student at Leaves Institute you can read and develop your knowledge of the industries that we work within, should any member of the Academic Staff recommend any reading, this is for your own personal development and research and Leaves Institute reserves the right to does not agree, promote, endorse or concur with any recommendations, copy, writing suggested for reading.

  6. Internal Communication. For questions concerning your course, you will be able to contact your Leaves Course Tutor and/or Leaves Tutor or Leaves Mentor directly via your own “inbox” which acts as Leaves Institutes internal communication system. You will learn how to contact or notify members of the Academic team during your induction. Students need to be aware that academic staff reside and work from different time zones across the world so please be aware that there could be some delay in response time. However we always endeavour to respond within 24/48 hours of receipt of any email enquiries or enquiries through our VLE (virtual learning environment).

Section C: Enquiries, Applications and Booking Courses›

  1. Enquiry Response Procedure: Enquiries can be made via a linked form embedded within the website or via e-mail to hello@leavesinstitute.com. There will be an automated e-mail stating that the enquiry has been received. Leaves Institute has a 3 working day policy to respond to emails. Leaves Institute will respond with a direct and welcoming reply by a Leaves representative via e-mail. Additionally the website has ‘book a call’ option directly linked to the staff body calendars to speak directly with potential applicants.

  2. Purchasing Courses. In order to purchase any of the Leaves Institute courses, you can purchase directly on the website. When you complete the application form and pay, you then have a space on the course. Once a space has been allocated you will receive an email with the next steps required to complete your enrollment on the course. When you agree to accepting a space on one of our courses via email or make a payment for a Leaves Institute Course, you are stating that you agree with these Terms and Conditions. A non-refundable application fee is payable on booking your space for certain courses. We will prompt you when payment in full is required. Leaves Institute reserves the right to cancel or decline your booking or any part of your booking at any time until it has been confirmed in accordance with clause 20 below.

  3. Agreement. A legally binding agreement between Leaves Institute and yourself, shall come into existence when we have:
    (a)    Received and accepted your space allocation on the course you have applied for, you will receive confirmation via email, and/or the website.
    (b)    Received the required payment from you in accordance with clause 5. below. 

  4. Application Fee. Please be aware that any application fee that is charged when you request a space on one of our courses, is a non-refundable deposit..  

  5. Dual Courses. Where your booking of course space consists of multiple Online Courses, each individual course will be treated by us as a separate purchase. 

  6. Becoming a Fully enrolled Leaves Institute student. On receipt of the full payment required for each course, the applicant officially becomes a student of Leaves Institute and will be sent confirmation via their Student Welcome email.

  7. Enrollment. Each student will receive an email to be enrolled on each individual course they will be completing. An email will be sent prior to the start of your course, with details and log-in to ensure you are prepared for the start of your course. 

  8. Debt. When a student agrees to these terms and conditions, he/she is accepting that:

7.1 Leaves Institute has the right to withhold my award certificate and that he/she may be excluded from attending an awards ceremony until such time as the debt is cleared. 

7.2 He/she understands that debt to the college includes (but is not restricted to) tuition fees, field trip contributions, library and other fines, damages and other miscellaneous debts. 

7.3 He/she understands that if they are in debt to Leaves Institute, they cannot register until that debt is cleared.

  1. Subscribers/Registering Interest. Should you wish to receive leaves Institute emails about our courses and education, please subscribe via our website at www.leavesinstitute.com or email your interest to hello@leavesinstitute.com. Once you have emailed us for information, you will automatically be added to our database to receive information. You can opt out of this by unsubscribing within any emails you receive from us or by informing us directly via hello@leavesinstitute.com. There is no payment required to register your interest in a course. This simply allows our administration team to keep you up to date on the latest information regarding our courses. We can also notify you when applications open for the course that you are interested in.  

  2. Use of Real Names. Leaves Institute requires all students to use their real names during application and throughout their education at Leaves Institute and throughout all our learning platforms. Leaves Institute reserves the right not to qualify, certify or accredit any student believed to have given false information or incorrect names during their time as a leaves Institute student. Leaves Institute will only issue certificates with students full real names and we reserve the right to request identification documents to prove students' real names should we deem it necessary.

  3. Personal Data and Identity Certification:  I understand that the information given during the Leaves Institute enrolment process and in the enrolment process for my course will be used in many areas of my Leaves Institute learning experience, including details that will appear on my final award certificate. Applicants will be expected to upload evidence of identity certification along with their application.  This can be a passport, driving license or other official document. Leaves Institute reserves the right to disqualify students who have given incorrect or false information about themselves. All students may be required to prove their identity again prior to certification being issued. 

  4. Change of Personal Data. Should any of our students change their personal information, including their name, address, email, telephone number given during the enrollment process it is the students responsibility to inform our head office immediately via hello@leavesinstitute.com. Any change of name must be supported by documentary evidence e.g. marriage certificate, deed poll.

  5. Professional Documentation. It is understood that Leaves Institute will not be liable for any out of date information or incorrect information that I have provided and that I will be responsible for any consequences (such as the cost of reissuing documents or certificates, if the college is able to do so) of not keeping my information correct and up to date.

  6. Dual Diploma and Dual Master Students. Students choosing to complete a Dual Diploma and/or Dual Master, and/or any other courses in conjunction with another course are committing themselves to a set of recommended hours needed for their learning. Leaves Institute is not responsible for the students inability to complete the course or submit assignments on time. It is the students responsibility to complete all course requirements, all students agree that they understand and commit to the hours needed for their learning on booking a course at Leaves Institute. Students are required to keep their Course Tutor informed if they undertake more than one course at a time and are responsible for any additional studies or work that may impact on their ability to study

  7. Assignments. All assignments given within each academic term, must be successfully passed with a minimum grade of PASS to proceed to gain the certification your course offers.  For details of retrieval of failed assignments see Assessment Policy which can be found HERE. The grading scheme can also be found in the Assessment Policy. 

  8. Cancellation and Variation. Subject to clause 33 below, where we have accepted/confirmed the courses/services purchased by you and formed a legally binding agreement with you in accordance with our terms and conditions, then you are permitted 14 working days cooling off period starting on the day after the date we have concluded our agreement via email, to cancel your purchase of the course or services. Payment Terms are agreed on confirmation of acceptance of allocated space on the course and are offered on a case by case basis. 

  9. Online Course Purchase. If you have purchased an online course and have already accessed, downloaded all or part of the Online Course and/or started to use that Online Course then you shall forfeit the right to cancel your order.

  10. Cancellation/Variation of courses. There is no other right to cancel or vary your purchase of courses or any other cancellation/or variation of courses. Once a space has been confirmed and accepted by email, any changes required by the student and/or Leaves Institute to the course delivery will be entirely at the discretion of Leaves Institute.

Section D: Fees and Payment Methods 

The Fees for the courses shall be confirmed at point of application, Leaves Institute reserves the right to amend and update prices of their courses at any point.

  1. Course Fees. Unless otherwise specified at the time you purchase the courses, the Fees could be subject to VAT or other local taxes.

  2. Consumer Rights. Leaves Institute respects Consumer Rights Laws appropriate to the country in which payment was made. Examples include: Japan: Act on Specified Commercial Transactions (Amended 2016): UK: The Consumer Rights Act 2015. 

  3. Payment. I understand that the payment is made online and directly saves a place on the course. Payments are made through Stripe and Paypal via Squarespace which has its own T&C’s to be adhered to. I understand that failure to make payments by the agreed date may result in revoked access to my online course and termination of my enrollment and/or withholding of awards or certification.

  4. Tuition Fees. I understand that tuition fees set at the start of my course will remain fixed for the duration of the Academic Year in which I started my course.

  5. Required Fees. All required fees started by email, must be paid in full prior to you attending any of the courses or accessing the on-line learning materials.

  6. Additional Costs. Students are responsible for all additional costs incurred in connection with your attendance and learning via your course at Leaves Institute, including any specified technical requirements and equipment required to gain continued access to any Online Course (eg Laptop, tablet, internet connection).

Section E: Liability

  1. No part of the provision of the services or courses shall be deemed to be, nor is it intended to be, nor should it be taken to be, the provision of investment advice.

  2. Although Leaves Institute aims to provide education to the highest standards of the healing profession, neither it, nor its trainers accept any liability for:

(i) any inaccuracy or misleading information provided in the programmes or Course Materials   and any reliance by Client on any such information,

(ii) any loss or corruption of data,

(iii) any loss of profit, revenue or goodwill, or 

(iv) any indirect, special or consequential loss arising from any breach of the terms of this Agreement, no implied conditions, warranties or other terms apply.

  1. Leaves Institute total liability arising from or in connection with these terms and conditions and in relation to anything which we may have done or not done in connection with these terms and conditions and the delivery of the service (and whether the liability arises because of breach of contract, negligence or for any other reason) shall be limited to the Fees received by us in connection with the relevant Online Course or Leaves Institute Event in relation to which a dispute has arisen.

  2. Nothing in this Agreement shall exclude or limit Leaves Institute liability for (i) death or personal injury caused by negligence, (ii) fraudulent misrepresentation or (iii) any other matter which under English law may not be limited or excluded.

  3. No claim may be brought more than one month after the last date on which the services concerned have finished or ceased to be provided by us.

Section F: Intellectual Property

  1. All Intellectual Property Rights in the Course Materials, Online Courses and the speeches made by Yumiko Asakura and all Leaves Academic staff within the taught courses are, and remain, the intellectual property of Leaves Institute, whether adapted, written for or customised for the client or not.

  2. You are not authorised to:-

(i) copy, modify, reproduce, re-publish, sub-licence, sell, upload, broadcast, post, transmit or distribute any of the course materials without prior written permission;

(ii) record on video or audio tape, relay by videophone or other means the online course, taught course or Leaves Event;

(iii) use the course materials in the provision of any other course or training whether given by us or any third party trainer;

(iv) remove any copyright or other notice of Leaves Institute or the course materials.

(v) modify, adapt, merge, translate, disassemble, decompile, reverse engineer (save to the extent permitted by law) any software forming part of the online courses

(vi) Share or allow access to Canvas to anyone else who is not a fellow student on your course. Any shared course content, such as lectures, documentation or any other educational material will be deemed a breach of this agreement. 

  1. Breach of our Intellectual Property shall allow us to immediately terminate these terms and conditions with you and cease to provide you with any services, including but not limited to access to the online courses.

Section G: Malpractice and Maladministration / Code of Conduct / Plagiarism

  1.  I understand that Leaves Institute and its validating, accreditation, approval bodies and education partners take the offence of plagiarism, malpractice and maladministration to be of a serious nature, as set out in the Academic Misconduct Policy and in breach of the Student Code of Conduct and Student Contract. These policies are available via head office via hellohello@leavesinstitute.com 

  2. I understand that Leaves Institute may take measures to ensure that plagiarism is detected and addressed. I understand that Leaves Institute will undertake an investigation and subsequently any disciplinary action deemed appropriate, which could result in the student being disqualified from their course with no refund for any services lost.

Section H: Student Communication

  1. Student Communication Channels: I note that Leaves Institute will channel all formal student communications through the VLE Platform and the “inbox” within the VLE Platform. Leaves Institute will also email details directly to students via their submitted email given at the point of enrollment, which could include information about tuition fees, registration, assignments and notification of formal results.

  2. Student Responsibility:  I understand that it is my responsibility as a student at Leaves Institute to ensure that I check my email and Canvas to ensure I receive important announcements and educational information. As a student at Leaves Institute you are advised to check Canvas on a regular basis to keep yourself informed on Leaves Institute matters. Leaves Institute will not be held responsible for any misunderstood or misleading communication that may have led to a misunderstanding.

  3. Withdrawal, exclusion or interruption of study. As a student at Leaves Institute, I understand that I am required to abide by the Leaves Institute procedures on withdrawal/interruption of study described later in this document, should the situation arise.See p15 

  4. Attendance and Submissions. As a student at Leaves Institute, I understand that if I am not maintaining sufficient attendance and/or not submitting my assignments to achieve satisfactory academic progress without notifying my Course Tutor via inbox and/or the office on hello@leavesinstiutute.com, Leaves Institute reserves the right to withdraw me from my course of study. I also note that in such circumstances I will be charged for tuition for the full term within which my study and enrollment on the course was terminated. 

Section I: Equality and Diversity

  1. I understand that Leaves Institute values the diversity of its staff and students and I agree to act in accordance with the Equality and Diversity policy available on the college website. I understand I have a responsibility as part of the college community to promote equality of opportunity and diversity and to help eliminate unlawful discrimination. Section J: GDPR Privacy and Safeguarding Notice 

  1. I understand that Leaves Institute  has a GDPR Privacy Notice that describes what personal data Leaves Institute collects, processes, shares and retains during the application and enrollment processes and during my period of study. The Privacy Policy can be found HERE

  2. I understand that Leaves Institute has a Safeguarding Policy in place and that all applicants are bound to the requirements and terms of this policy. The safeguarding policy can be found here: Safeguarding Policy Leaves Institute 2020

Section K: Confidential and Exclusive use of Online Course Materials and Software.

  1. In consideration of the Fees paid as a student at Leaves Institute, we grant to you a limited, non-transferable, licence to use the course materials and the software for your own personal use only for the sole purpose of completing the Online Course. 

  2. As a student at Leaves Institute, only yourself can be involved within live lectures and tutorials. All course delivery including all lectures, can only be watched by students who have paid for a space on the course. 

  3. Any student who has shown content to others would be in breach of this contract and Leaves Institute retains the right to dismiss and discontinue access to the VLE Platform and all aspects of course delivery. 

  4. Leaves Institute retains the right to all fees paid for the term in which the student was dismissed from the course, and all prior Academic Terms completed within the academic year in which the student was dismissed from the course. 

  5. All Leaves Institute students will be required to read and accept the Terms of the Student Code of Conduct which can be found HERE.  The exclusive use and access to Leaves Institute Digital resources and learning materials is also outlined as a condition within the Student Contract which can be found here: STUDENT CONTRACT LEAVES INSTITUTE 2020

Section L: Confidentiality

  1. Each party shall keep the other party’s Confidential Information strictly confidential and not use it otherwise than for the purposes of these terms and conditions and shall return it on demand and not retain copies of it.

  2. Either party may disclose Confidential Information to its legal and other advisors for the purposes of obtaining advice from them.

  3. This clause shall continue notwithstanding termination of these terms and conditions.

Section M: Termination

  1. We shall be entitled to terminate these terms and conditions and cease to provide you with any services with immediate effect in the event that you:

  2. Fail to pay when due your Fees;

  3. Act in an aggressive, bullying, offensive, threatening or harassing manner towards any employee of Leaves Institute, and/or any Tutor who provides the taught courses and/or any student who attends any Leaves Institute Course;

  4. Cheat or plagiarise any work which you are required to prepare or submit in connection with the courses as outlined in our Academic Misconduct Policy which can be found  HERE and within the Leaves Institute Assessment Policy which can be found HERE

  5. Steal or act in fraudulent or deceitful manner towards us or our employees or any other students who may be attending Leaves Institute courses or events. 

  6. Intentionally or recklessly damage our property or the property of our employees and/or other students attending any events.

  7. Are intoxicated through alcohol or illegal drugs while on our premises or event venue.

  8. Commit any criminal offence on our premises or at one of our venues where the victim is our employee or student

  9. Are in breach of these terms and conditions.

Section N: Criminal Conviction

  1.  I understand that as part of the admissions and enrolment processes I am required to disclose any relevant unspent criminal convictions.

  2.  I may also be required to disclose all convictions and cautions - whether spent or unspent (with the exception of Protected Convictions and Cautions as defined by the Rehabilitation of Offenders Act 1974) and to undergo a Disclosure and Barring Service (DBS) application.  I understand that the pre-course information will identify courses where this is a requirement, and I will be reminded of this by the Institute at the offer stage. I understand that I am required to inform Leaves of any changes to my circumstances which may affect my DBS status and my position regarding the conditions of my offer or place on a programme.

Section O: Professional Practice

  1.  I understand that if I am studying on any of the programmes listed below that I am to conform to the Leaves Institute Code of Conduct, Ethics and Practice policy as this is a requirement from the professional body that accredits my qualification. I understand that failure to comply with the Professional Practice Policy could result in exclusion from my course.

  2. Comply with Leaves Institute requirements to retain Certification and awarded Title to Practice Professionally. 

  3. Supervision. I understand that I must have regular clinical Leaves Institute Supervision with a qualified and certified Leaves Supervisor throughout the first year of my practice and every year thereafter I must complete the required 

  4. CPD Hours: (Continual Professional Development) to retain my certification to practice as a Leaves Practitioner and/or Leaves Master Practitioner, I understand that CPD is a requirement and a condition of retaining my right to practice as specified by the GRCCT (General Regulatory Council for Complementary Therapies) and CNHC ( The Complementary and Natural Healthcare Council.   5. Title and Certification: To continue to comply with Leaves Institute requirements and to retain my Certification and the awarded Leaves Institute Title to Practice Professionally, I understand that I must continue to develop myself professionally annually to ensure I update and maintain the standards of professional practice and keep abreast of new methodologies and research relevant to the profession. 

  6. CPD Evidence File: I understand that I must complete CPD (Continuous Professional Development) annually. I understand it is my responsibility as a student and/or graduate of Leaves Institute to ensure I have maintained the amount of hours of CPD required annually by professional approval bodies to continue to practice professionally. . It is also the student and graduate’s responsibility to keep a record of CPD Activity.

Section P Your Right to Cancel 

  1. I understand that my offer of a place at Leaves Institute will be confirmed to me by email.  I understand that this email of confirmation forms a legal contract between myself as a student at Leaves Institute on the basis of the terms and conditions set out in this document and within my offer email. I understand that Leaves Institute may end this contract if I fail to meet the conditions required or fail to comply with the terms and conditions set.

  2. I understand that I have the right to cancel this contract under the Consumer Contract (Information, Cancellation and Additional Payments) Regulations 2013 within 14 days without the need to provide any reason.

  3. I understand that this cancellation period will expire 14 days following receipt of my acceptance of an offer of a place on a Leaves Institute Course.

  4. I understand that I will be reimbursed any payments made prior to the cancellation. I understand that if I have commenced my studies within the 14 day cancellation period, I will be charged an amount proportionate to the services received prior to the communication of my intention to cancel.

Section Q: Additional Student Support and Reasonable Adjustments 

  1. I understand that I am advised to discuss any support needs or disabilities which may affect my ability to study on my selected programme with Student Services and the relevant Course Tutor.

  2. I understand that Leaves Institute will always endeavour to make any reasonable adjustments required and I understand that ongoing support is available throughout my study with the institute. 

  3. I understand that additional payment will be charged for any additional student support requested outside of my main course delivery.

Section R: Data Protection

  1. The nature of the Services provided by us means that we will obtain, use and disclose (together "Use") certain information about you ("Data"). This statement sets out the principles governing our Use of Data. By purchasing our courses, you agree to this use.

  2.  When you register with us you will need to provide certain Data such as your contact details and demographic information. We will store this Data and use it to contact you, provide you with details of the courses/services you have purchased and use as required during the normal provision of the course.

  3. We may also use the above Data, and similar Data you provide us in response to surveys and student feedback to aggregate user profiles and provide you with communications. We will not pass any personal data onto anyone outside of Leaves Institute. 

  4.   6.  Leaves Institute endeavours to take all reasonable steps to protect your personal Data including the use of encryption technology but cannot guarantee the security of any Data you disclose. You accept the inherent security implications of being and transacting on-line over the internet and will not hold us responsible for any breach of security.

  7. Leaves Institute may supplement the information that you provide with information we receive from third parties, such as exam registration bodies or your previous employers for example in the case of RPL, Recognition of Prior Learning or APL, Accreditation of Prior Learning.

Section S: Changes to Courses, Course Content, Delivery or Timetables

Leaves Institute makes all reasonable efforts to deliver the courses, additional opportunities and other services and facilities described in this publication and other Leaves Institute documents.

However, Leaves Institute may in some circumstances be required to:

  1. Make reasonable variations to the content and/or syllabus of courses and/or Assignments.

  2. Alter the timetable, location, number of courses and/or method of delivery of programmes of study and methods and timings of assessments, provided such alterations are reasonable and necessary. Leaves Institute may make reasonable changes to its regulations, policies and procedures,  combine programmes of study,  suspend, discontinue or not provide courses. 

  3. Take the actions outlined above in the following circumstances and/or for the following reasons:

  • If the institute reasonably considers this to be necessary in order to appropriately manage its resources and/or provide continuous improvement in the best interests of students

  • To comply with the requirements on a regulatory or professional standards body or educational accrediting body

  • Because a key member of staff is unwell or leaves the College and/or because too few students apply to join a programme for it to be viable

  • Due to developments in theories or practices in academic and professional areas, which will be in the best interests of students

  • To comply with changes in law or comply with the instructions advised by the College's regulators or a professional body

  • In order to implement enhancements recommended by the Leaves Institute Course Review and Enhancement Group OR identified through other quality assurance processes, student or partnering collaborative bodies. 

  • To ensure compliance with best practice in the sector and set out by professional accreditation or approval bodies. 

  • Other reasons that would make alteration in the best interests of the students. 

  • If Leaves Institute chooses to exercise its right to make changes in accordance with the above, it shall take all reasonable steps to notify the affected students and minimise any disruption to their studies.

  • In the unlikely event that Leaves Institute discontinues, fails to provide a programme of study or significantly changes the content or syllabus of a programme, method of delivery or method of assessment of a programme or the location at which a programme is taught, (in each case either before or after a programme begins):

  1. Leaves Institute will consider and implement any mitigation measures it concludes are reasonable and proportionate in the relevant circumstances, to minimise any disruption to students’ studies.

  • The institute will tell the relevant individuals at the earliest possible opportunity

  • Leaves Institute will seek to offer the individual a suitable replacement programme at the College for which the individual is qualified (and subject to the individual student meeting relevant conditions for the programme)

  1. If the individual does not wish to accept the Leaves offer of a replacement programme or the institute is unable to offer a replacement programme, an individual will be entitled to:

  • Withdraw his / her application

  • Withdraw from the programme

  1. In the event that the individual student withdraws, the College will make an appropriate refund of tuition fees and deposits paid. 

  2. Leaves Institute will provide students with educational services with reasonable care and skill. 

  3. Leaves Institute will also provide you with a range of pastoral and support services in addition to the services being provided under these Terms. 

  4. Please note that the availability and scope of these pastoral and support services are subject to change during your programme of study for a variety of reasons, including, but not limited to, in response to funding arrangements and the needs of students. 

  5. Leaves Institute therefore maintains discretion to vary and/or amend the availability and scope of pastoral and support services at any time.

  6. Leaves Institute will not be liable to you for any failure or delay in the delivery of provision outlined in this document if it is due to any event beyond our reasonable control eg. Strikes / industrial action, acts of God, National Emergencies

  7. If you do not agree to these terms and conditions, we will be unable to proceed further with your application or involvement in our research projects or events. 

Section T: Force or Act of Nature Disclaimer

  1. Leaves Institute shall not be liable to you for any breach of its obligations or termination under these terms and conditions arising from causes beyond its reasonable control, including, but not limited to, fires, floods, earthquakes, volcanoes and other Acts of God, terrorism, strikes, delay caused by transport disputes, failure to provide a course caused by a death in the trainer’s family, illness of the trainer, Government edict or regulation.

Section U: Withdrawal, Interruption or Exclusion from Study

  1. Withdrawal or Termination of Study: Should a student wish to withdraw from any course after the 14 day cooling off period, they will forfeit the portion of the fees that is represented by the unit or units they have already undertaken or had access to.  Withdrawal is a formal and conclusive decision and does not allow for return to study with the benefit of credits previously passed.  If a student withdraws, then wishes to return later to that course, the course will have to be commenced again and full fees will be payable. If the student has any desire to return to study on that same course when their circumstances have changed, they should choose to Interrupt or Intermit from study.  See below

  2. Interruption or Intermission from Study:  

2.1 A student may choose to interrupt or (Intermission) if they think that their current circumstance is not conducive to gaining the fullest benefit from the course.  The reasons could be personal circumstance or illness. Interruption allows the student to return to the course the following year and start officially on the unit following the last unit that they passed. 

2.2 In the instance of returning from Interruption, the student will only pay from the point at which they resume the course. There is however a requirement to ensure that the student is fit and ready to return to study and this will be done through a 121 tutorial and healing with the returning student. 

2.3 The returning student will be required to make a payment for the 121 tutorial and healing carried out under the Leaves Institute Duty of Care.  The point of the tutorial is to ensure that the student is not disadvantaged by missing the start of the course and to refresh the student on the last two units as preparatory for return to study.  There will be a Healing included in this process to enable the student to thrive and return unencumbered by past impediments to their learning.  

  1. Exclusion or Termination of Studies: 

Exclusion could be the result of breaches of the Student Code of Conduct, Student Contract, Plagiarism Misconduct or any other academic misconduct or maladministration mentioned in the Leaves Institute Policies. If a student is excluded, they will forfeit their fees up to the point of the Exclusion decision. Exclusion decisions will be taken by a panel consisting of Leaves Academics and Quality Managers (CREG) and the appropriate tutor. Wherever possible, a decision will be made within a 3 week period from notification of the offense or breach. 

Section V: Entire Agreement 

  1. These terms and conditions, together with any additional Course Specific Terms and Conditions are the entire agreement between the parties and supersede any prior agreements and arrangements, whether written or oral. 

  2. On confirmation of becoming a Leaves Institute student, you are stating that you have not relied on any representations in entering into these and any other terms and conditions with us.

  3. Nothing in this clause or terms and conditions shall limit liability for any fraudulent misrepresentation.

  4. Law and Jurisdiction. This Agreement is subject to English law and the parties submit to the exclusive jurisdiction of the English courts in connection with any dispute here under.
